Municipal Clerk Responsibilities on Absentee Voting Deadline Days

The G.A.B. has re-issued the guidance memo (attached) due to inquiries we continue to receive regarding municipal clerk’s availability to voters on Good Friday, March 29, 2013, the Friday before the Spring Election. This memo was also posted on our website on November 20, 2012 and January 24, 2013 under Clerks/Recent Clerk Communications.
Wisconsin law requires municipal clerk offices to be open, or the clerk to otherwise be available, on statutory deadline days up to the time stated by statute. We understand that some clerks are considering alternatives to being open on Good Friday, and possibly planning to make up for being closed on that day by extending absentee voting over the weekend or into the following Monday. Please review the attached memo from November 20, 2012, and note the following:
• There is no exemption from statutory deadlines on days which are not designated as State holidays.
• Municipal clerks who do not comply with the statutory deadlines risk an elector filing a complaint with the G.A.B. and a finding that the clerk is acting contrary to election laws.
• It is not an option to extend the in-person absentee voting deadline in place of being available on the last day of in-person absentee voting.
